Drain Waiver

MUST READ – CUSTOMER ASSUMES ALL LIABILITY ASSOCIATED WITH POOL DRAINING AND CHEMICAL CLEANING SERVICE. By allowing Az Cool Pools to drain and acid or chlorine wash your pool, you, the customer agrees you have read the disclosure below and assume all liability for the outcome of your pool structure and surface.

By allowing Az Cool Pools to drain your pool, you have read and agree to the disclosure below. Draining and chemically cleaning your pool comes with risk that you assume all liability for.

Pool Drain, Acid Wash, Tile Cleaning, and Chlorine Bath Disclosure: Waiver and Release of Liability Draining of Swimming Pool/Spa:

Customer acknowledges that by reading the contents of this waiver and release of liability, CUSTOMER is aware that certain of the following problems can arise from draining a swimming pool/spa and is accepting responsibility of the potential issues that can arise from draining the pool/spa.

POOL WATER DRAIN DISCLOSURE AND ACKNOWLEDGMENT By allowing Az Cool Pools to plug in the submersible pump to start and complete your swimming pool drain, you are agreeing this disclosure in its entirety. This disclosure applies to all pool/spa draining, chlorine or acid washes, tile cleaning and any work done while your swimming pool or spa are empty.

THE PURPOSE OF THIS STATEMENT IS TO PROVIDE YOU, THE CUSTOMER, WITH INFORMATION CONCERNING THE DRAINING FOR MAINTENANCE OF SWIMMING POOL WATER. DURING THIS PROCEDURE, THERE ARE CERTAIN RISKS THAT ARE NOT NORMALLY ASSOCIATED WITH DAY-TO-DAY POOL
MAINTENANCE, AND WHICH ARE NOT WITHIN THE CONTROL OF THE PERSON DRAINING YOUR POOL. THIS LETTER IS DESIGNED TO INFORM YOU
OF SOME OF THE RISKS AND POSSIBLE RESULTS OF THE POOL DRAINING

Draining Process Periodic draining of swimming pool water is a common maintenance practice. It is routinely performed to remove water that has become hard or laden with excessive minerals, or to perform needed maintenance, cleaning, or repairs to a pool. Normally, removal of water from a pool causes no problems. However, there are a few things that can happen of which you should be aware. When the water is removed, the pool is exposed to the heat of the sun and air, the pool may rise out of the ground, a condition often caused by hydrostatic pressure (i.e., too much water in the soil). Once exposed to the air, tiles may loosen or fall off; the pool surface can shrink, expand, crack, blister, flake or pop off, etc. These problems can occur and are beyond the control of the person who has simply “drained the water.” Customer agrees to accept all consequences of having drained the pool regardless of why the pool is being drained. Original pool builder could void warranty. The discharge of water remains the property and responsibility of the Customer along with all consequences and effects the water may cause. No warranty is given by the service contractor or the service individual covering any conditions resulting from the pool being drained. Restrictions on disposal of water from swimming pools vary from city to city; it is the customer’s responsibility to approve disposal location and procedures. After draining and/or work has been completed it is the customer’s responsibility to contact your water company to arrange for the refill of the pool with water.

Az Cool Pools is not responsible for the drain clean out overflowing or any flooding because of the draining process. It is the customer’s responsibility to locate the sewer clean outs on the property. Please do NOT allow children or others to be near the pool. It is the customers’ responsibility to turn off the hose filling the pool to prevent it from overflowing.

By allowing Az Cool Pools to start your pool draining, you have read and agree to the above-mentioned terms and liability.
